1. Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Fibricate LLC ("Fibricate," "we," "us," or "our"), governing your access to and use of fibricate.com (the "Site") and all products, services, and features offered through it.
BY ACCESSING OR USING THE SITE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MAY NOT ACCESS OR USE THE SITE.
2. Eligibility
You must be at least 13 years of age to use this Site. During account registration, you will be required to provide your date of birth. Account creation is technically blocked for anyone under the age of 13 at the server level. By creating an account, you represent and warrant that you are 13 years of age or older. Users aged 13 to 17 are considered minors under applicable state law and should use the Site with the knowledge of a parent or guardian, but federal law (COPPA) does not require parental consent for users 13 and older. Fibricate reserves the right to terminate any account where we have reason to believe the user is under 13 years of age.
3. Account Registration
3.1 Account Creation
To access certain features of the Site — including placing orders, submitting forms, or accessing exclusive content — you may be required to create an account. You may register using an email address and password, or via Google Sign-In through OAuth.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. Fibricate is not liable for any loss or damage arising from your failure to safeguard your credentials.
3.3 Account Termination
We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, Fibricate, or third parties.
4. Products and Services
4.1 Product Listings
Fibricate is an authorized reseller of select 3D printer brands, filaments, and accessories. Product availability, specifications, and pricing are subject to change without notice. We reserve the right to limit quantities or discontinue any product at any time.
4.2 Warranties
Extended warranty products may be available for purchase on eligible hardware. Warranty terms, coverage, and duration will be clearly described at the point of sale. Warranties are non-transferable unless otherwise stated. Once a warranty is activated or the return window has passed, warranty purchases are final and non-refundable.
4.3 Print-On-Demand Services
By submitting an STL or other design file for print services, you represent and warrant that: (a) you own or have the right to use the submitted design; (b) the design does not infringe the intellectual property rights of any third party; and (c) the requested print is not for any unlawful purpose. Fibricate reserves the right to refuse any print request at its sole discretion.
4.4 Training Modules
Digital training content, once purchased and accessed, is non-refundable. All training content is licensed to you for personal, non-commercial use only. Redistribution, resale, or public display is strictly prohibited.
4.5 Reseller and Print Farm Host Applications
Submission of a reseller or print farm host application does not guarantee approval. Fibricate reserves the right to approve or deny applications at its sole discretion and without obligation to provide a reason for denial.
5. Pricing and Payment
All prices are listed in US Dollars. Prices are subject to change without notice. Applicable sales tax will be added at checkout as required by law.
All payments are processed securely through Stripe. By completing a purchase, you agree to Stripe's Terms of Service and authorize Stripe to charge your selected payment method. Fibricate does not store or have access to your full payment card information.
6. Shipping and Fulfillment
Fibricate ships physical products to addresses within the United States. Estimated shipping times are provided at checkout and are estimates only — we cannot guarantee delivery dates. Risk of loss and title for physical items pass to you upon delivery to the carrier. Fibricate is not responsible for delays caused by shipping carriers, weather, or other events outside our control.
7. Returns, Refunds, and Cancellations
7.1 Physical Products (Printers, Filaments, Tool Kits)
We accept returns of physical products within 30 days of the delivery date, provided the item is unused, in its original packaging, and in resalable condition. To initiate a return, contact us at the email below. Return shipping costs are the responsibility of the customer unless the return is due to a defect or our error. Refunds will be processed to the original payment method within 7–10 business days of receiving the returned item.
Note: Items showing signs of use, damage, or missing original packaging may be subject to a restocking fee or denied at our discretion.
7.2 Digital Products and Training Modules
All sales of digital products, training modules, and downloadable content are final. No refunds will be issued once digital content has been accessed or downloaded.
7.3 Extended Warranties
Warranty purchases are non-refundable once activated or once the 30-day return window for the associated hardware has passed.
7.4 Print Services
Print service orders may be cancelled without charge prior to production beginning. Once production has commenced, cancellations are not accepted and no refund will be issued. If a completed print is defective due to our error, we will reprint or refund at our discretion.
8. Intellectual Property
All content on the Site — including text, graphics, logos, images, product descriptions, software, training materials, and design — is the property of Fibricate LLC or its content licensors and is protected by applicable copyright, trademark, and intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from the Site without prior written permission from Fibricate.
Design files and STL files you submit remain your property. By submitting them to Fibricate for print services, you grant us a limited, non-exclusive license to use those files solely for the purpose of fulfilling your print order.
9. User Conduct
By using the Site, you agree not to:
- Violate any applicable local, state, or federal law or regulation
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Submit false, misleading, or fraudulent information in any form
- Upload or transmit any content that is unlawful, defamatory, obscene, or infringing
- Use automated means (bots, scrapers, crawlers) to access the Site without our express written permission
- Interfere with or disrupt the integrity or performance of the Site or its infrastructure
- Attempt to gain unauthorized access to any portion of the Site or its related systems
10. Reseller and Partner Program Terms
Approved resellers and print farm hosts are subject to a separate Reseller Agreement or Partner Agreement that will be provided upon approval. In the event of a conflict between those agreements and these Terms, the separate agreement shall control.
11. Disclaimers
THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FIBRICATE DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FIBRICATE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR PRODUCTS, EVEN IF FIBRICATE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FIBRICATE'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO FIBRICATE IN THE 12 MONTHS PRIOR TO THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).
13. Indemnification
You agree to defend, indemnify, and hold harmless Fibricate LLC, its officers, directors, employees, contractors, and agents from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content or files you submit to Fibricate.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Indiana, and you consent to personal jurisdiction in those courts.
PLEASE NOTE: Fibricate encourages you to contact us directly to resolve any disputes before initiating legal proceedings.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the effective date and, where appropriate, by email notice. Your continued use of the Site after changes take effect constitutes your acceptance of the revised Terms.
16. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Fibricate regarding your use of the Site and supersede all prior agreements and understandings.
